Terms of Use

BHC Staffing Solution Corp

1.  Introduction and Scope

  • This Agreement governs the terms under which clients, service users, business partners, and licensed professionals (collectively referred to as “Users”) access and utilize services offered by BHC Staffing Solution Corp (“BHC”, “Company”, “we”, or “us”). The Company provides a staffing and scheduling platform for independently licensed barbers, hairstylists, and cosmetologists delivering services at client locations or business premises within the State of New York.

2.  Eligibility Requirements

To access or utilize BHC services, Users must be at least 18 years of age and legally capable of entering into contracts. Minors may receive services only under the express authorization and presence of a parent or legal guardian. Users must not be subject to any restrictions imposed by local, state, or federal laws that would prohibit participation in the platform, including but not limited to listing on sex offender registries or having been convicted of violent or sexual crimes.

3.  Nature of the Relationship

BHC acts solely as a facilitator, connecting clients with independently contracted, state-licensed professionals. All service providers operate under their own licenses and liability, and are neither agents nor employees of BHC. The Company does not exercise control over the manner, method, or outcome of the services provided.

4.  Independent Contractor Agreement

All professionals operating under BHC’s platform are classified as independent contractors. Each contractor shall:

  • Maintain active and valid professional licensure under New York State laws.

  • Carry general liability insurance in accordance with local regulatory requirements.

  • Retain control over their schedule, pricing, equipment, and service techniques.

  • Agree to abide by BHC’s platform usage rules and quality standards.

Contractors acknowledge and agree that they are not entitled to benefits associated with employment, including but not limited to workers’ compensation, unemployment insurance, or health benefits.

5. Client Appointment Policies

Appointment Scheduling and Booking

  • Clients are required to schedule appointments in advance through our online booking system or by contacting our designated phone line.

  • Same-day appointments are subject to availability.

 

Cancellation and Rescheduling

  • Clients must provide a minimum of 24 hours’ notice for cancellations.

  • Late cancellations or no-shows will result in no refund or loss of deposit.

  • Appointments can be rescheduled with reasonable notice, and we strive to accommodate changes when possible.

  • If a scheduled independent contractor cancels and a suitable replacement cannot be arranged, the client will receive a full refund or may choose to reschedule without additional charge.

  • Refunds will not be issued by BHC for dissatisfaction with services rendered, unless there is clear evidence of misconduct, breach of contract, or non-performance then clients must submit refund or credit requests within 12 hours.

  • BHC is not liable for cancellations or service interruptions caused by events outside of our control (e.g., severe weather, emergencies, transportation issues). Refunds or credits will be issued at BHC’s discretion.

6.  Client Responsibilities and Conduct

Clients agree to:

  • Provide a safe, sanitary, and accessible environment for in-home or on-site services.

  • Inform service providers of any relevant health conditions, allergies, or risks prior to service.

  • Refrain from discriminatory, abusive, or unlawful conduct toward staff or contractors.

Failure to comply may result in termination of service or platform access.

 

7.  Contractor Conduct and Safety Standards

Contractors agree to:

  • Conduct services in accordance with New York State laws, industry best practices, and hygiene protocols.

  • Comply with applicable COVID-19 or infectious disease protocols, including PPE and disinfection practices.

  • Refuse or discontinue service if the environment is deemed unsafe or if the client is unfit for service due to health or behavioral concerns.

8.  Limitation of Liability

To the fullest extent permitted by law, BHC disclaims all liability for personal injury, property damage, or economic loss resulting from services rendered by independent contractors. Clients and contractors expressly release BHC from liability arising from acts, omissions, negligence, or misconduct outside of BHC’s direct operational control.

 

9.  Data Privacy and Confidentiality

BHC collects and stores client and contractor information necessary to facilitate bookings and ensure service quality. All personal data is handled in compliance with the New York State SHIELD Act and relevant privacy laws. BHC will not sell, lease, or disclose personal data to third parties without consent, except where required by law.

 

10.  Platform Ownership and Intellectual Property

The BHC website, application, logos, and proprietary content remain the exclusive intellectual property of BHC Staffing Solution Corp. Users are granted a limited, non-transferable license to use the platform solely for legitimate business or personal service booking purposes.

 

11.  Termination of Access

BHC reserves the right to suspend or terminate platform access for any User who violates these terms, fails to comply with legal requirements, or engages in conduct detrimental to the Company’s business or reputation.

 

12.  Changes to Terms

BHC may amend these Terms at any time by providing notice on its website or via email. Continued use of the platform following changes constitutes acceptance of the revised Terms.

 

13.  Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of New York. All disputes shall be subject to the exclusive jurisdiction of courts located in New York City, Nassau County, or Suffolk County, depending on where the service was rendered.

 

14.  Acknowledgment and Consent

By using BHC Staffing Solution Corp’s platform or services, all Users—whether clients, business entities, or independent contractors—affirm that they have read, understood, and agreed to abide by these Terms of Use and the conditions of independent service delivery.
